Divorce Records California - Children
As a general rule, California divorce records relating to children and child support payments are not
available for public viewing, However, the Family Code specifically authorizes protected documents to be used in
the following circumstances:
- administrative, civil, or criminal investigations;
- actions, proceedings, or prosecutions conducted in connection with the administration of the child and spousal support
enforcement programs; and
- requests by county welfare departments responsible for administering a program operated under a state plan
established pursuant to Part A, Subpart 1 or 2 of Part B, or Part E of Subchapter IV of Chapter 7
of Title 42 of the United States Code.
Courts may issue an order to allow anyone access to protected California divorce records. Also, anyone
charged with responsibility for preparing protected California divorce records may examine their documents with
or without a court order, including parents preparing for a hearing to modify a court order pertaining to
themselves, their children, or other matters directly related to personal liability.

- The availability of online California divorce records is subject to the same restrictions as other
records available through the clerk's office.
- A direct relationship and interest in the welfare of a child is required for access to California divorce
records containing information regarding the financial condition, age, location and parentage of a child.
